1. Overview

This website is operated by Iron Bear Collectibles, located at 16650 Guejito Road, Escondido, CA 92027. Throughout these Terms, “we,” “us,” and “our” refer to Iron Bear Collectibles.

These Terms govern your use of our website and purchases from our online store. Our store is hosted on Shopify, which provides the ecommerce platform we use to offer products and process orders. Purchases from this store are transactions with Iron Bear Collectibles.

Please read these Terms, our Refund Policy, Shipping Policy, and Privacy Policy before placing an order. By placing an order, you agree to the terms presented to you at checkout, to the extent permitted by applicable law.

2. Eligibility and Authorized Purchases

You must be at least the age of majority in your jurisdiction, or have a parent or legal guardian complete the purchase on your behalf.

You agree to provide accurate information and use only payment methods you are authorized to use. You may not use our website or products for unlawful purposes.

3. Products and Descriptions

We sell collectibles, toys, trading cards, sports cards, and related merchandise. Products may be limited in quantity and subject to purchase limits.

We make reasonable efforts to accurately describe products, including their condition and any known material imperfections. Screen settings, lighting, and photography may affect how colors and details appear online.

Unless expressly stated in the product listing, we do not guarantee mint packaging, a particular professional grade, or future resale value. Manufacturer variations and disclosed minor packaging imperfections do not, by themselves, qualify an item for a return.

Nothing in these Terms excuses delivery of an incorrect, materially misdescribed, or legally defective product.

4. Pricing and Payment

Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes and shipping charges are shown at checkout.

Prices and promotions may change without notice for future purchases. A subsequent price reduction does not entitle a customer to a price adjustment on a completed purchase.

Payment is due at checkout unless a different arrangement is expressly offered. Any installment or third-party financing service is also subject to that provider’s terms.

5. Order Acceptance and Cancellations

An order confirmation acknowledges receipt of your order and does not guarantee availability or fulfillment.

We may decline or cancel an order for a legitimate reason, including unavailable inventory, a material listing or pricing error, suspected fraud, unauthorized payment, or violation of clearly disclosed purchase limits.

If we cancel an order after collecting payment, we will promptly refund the amount paid for the canceled portion, including applicable taxes and associated unfulfilled shipping charges. We will not increase the price of an existing order without your agreement.

Customer-requested cancellations are not accepted except as provided in our Refund Policy or required by law.

6. All Sales Final

All sales are final. We do not accept returns, exchanges, or customer-requested cancellations, and we do not issue refunds or store credit, except as expressly provided in our Refund Policy or required by applicable law.

This includes requests based on buyer’s remorse, duplicate or accidental purchases, finding a lower price elsewhere, changes in collecting preferences, or changes in market value.

Our Refund Policy explains how we handle incorrect, damaged, defective, canceled, or unfulfilled orders. Nothing in these Terms limits consumer rights that cannot legally be waived.

7. Preorders

Items identified as preorders are not available for immediate shipment. Payment requirements and estimated shipping dates are stated in the product listing.

Estimated release and shipping dates may change because of manufacturer, distributor, or transportation delays. If we cannot ship within the stated timeframe, we will provide any legally required delay notice and options to consent to the delay or cancel for a refund.

If a product is canceled or we cannot fulfill your preorder, we will promptly refund the amount paid for the unfulfilled item, including applicable taxes and associated unfulfilled shipping charges, to the original payment method.

A preorder does not waive any legally required cancellation or refund rights.

8. Trading Cards, Blind Boxes, and Mystery Products

Sealed packs, booster boxes, blind boxes, mystery products, and similar items contain randomized contents unless the listing expressly states otherwise.

We do not guarantee specific cards, characters, chase items, rarity levels, grades, or resale values beyond what is expressly advertised. Dissatisfaction with randomly selected contents does not qualify for a return, exchange, refund, or store credit.

Any guaranteed contents or special conditions will be disclosed in the listing before purchase.

9. Shipping and Delivery

Shipping charges, processing estimates, and available delivery options are provided at checkout or in our Shipping Policy.

Customers are responsible for providing a complete and accurate delivery address. Contact us promptly if an address correction is needed. We cannot guarantee changes after an order enters fulfillment.

Carrier delivery estimates are estimates unless we expressly offer a guaranteed service. If an order is missing, damaged, or incorrectly delivered, contact us so we can investigate and provide the remedy required by applicable law.

A delivery scan does not automatically resolve a claim of nonreceipt.

10. Incorrect, Damaged, or Defective Merchandise

Please report an incorrect item, shipping damage, or material defect promptly using the contact information below. Include your order number, a description of the issue, and photographs when available.

Retain the merchandise and packaging for review, and obtain return instructions before shipping an item back.

We will investigate and provide an appropriate remedy consistent with our Refund Policy and applicable law. A request to report an issue promptly does not shorten any legally protected claim period.

11. Accounts and Website Use

If you create an account, you are responsible for safeguarding your login credentials and notifying us of suspected unauthorized access.

You may not use the website to commit fraud, impersonate another person, introduce malicious software, interfere with store operations, or obtain unauthorized access to systems or customer information.

We may restrict website or account access for violations of these Terms, subject to applicable law. Restricting access does not eliminate our obligations concerning paid orders.

12. Intellectual Property

Our original website content, branding, photographs, graphics, and text are owned by Iron Bear Collectibles or used with permission. You may not reproduce or commercially exploit this material without authorization, except as permitted by law.

Third-party product names, characters, logos, and trademarks belong to their respective owners. Their appearance on our website does not imply an affiliation or endorsement beyond any relationship expressly disclosed.

13. Reviews and Customer Submissions

If you submit a review, photograph, or other content for publication, you confirm that you have the necessary rights to share it.

You grant us a nonexclusive, royalty-free license to display that submission and make reasonable formatting changes in connection with our store and product marketing. Our use remains subject to applicable privacy and publicity laws.

Reviews must reflect honest experiences. We may remove unlawful content, spam, threats, or content that exposes another person’s private information. We do not prohibit honest negative reviews.

14. Third-Party Services and Links

Our website may offer third-party payment services, applications, or links. Those providers may have separate terms and privacy practices.

We are responsible for our own obligations as the seller. Third-party terms do not eliminate any consumer rights or responsibilities that apply to our transactions.

15. Privacy

Our collection and use of personal information are described in our Privacy Policy. Please review that policy before submitting personal information or placing an order.

16. Warranties and Limitation of Liability

We do not promise uninterrupted or error-free website access.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from website use, including speculative profits or anticipated increases in collectible value.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including applicable statutory warranties, consumer remedies, or liability for fraud, willful misconduct, or gross negligence.

Any manufacturer warranty is separate from your rights against us under applicable law.

17. Disputes and Governing Law

Please contact us first about a concern so we have an opportunity to investigate and resolve it. This request does not prevent you from exercising lawful dispute, payment, or court remedies.

These Terms are governed by the laws of the State of California, subject to any mandatory consumer protections applicable to you. Nothing in this provision deprives you of rights or access to courts that applicable law guarantees.

18. Changes to These Terms

We may update these Terms by publishing a revised version with a new “Last updated” date.

Updates apply prospectively. The terms presented when you place an order govern that purchase unless a change is required by law or you expressly agree otherwise.
